Terms of Service

Welcome to VexSMP. These Terms of Service ("Terms") govern your access to and use of the VexSMP website located at vexsmp.space (the "Website"), the VexSMP Minecraft game server (the "Server"), and any related services we provide (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing the Website, connecting to the Server, or making a purchase through our Store, you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use our Services.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. For significant changes, we will post an announcement in our Discord server. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

"VexSMP", "we", "us", "our": The operators and administrators of the VexSMP Minecraft server and website.

"You", "your", "User": Any person who accesses or uses any part of our Services.

"Player": A User who connects to the VexSMP Minecraft game server.

"Staff": VexSMP administrators, moderators, and other team members authorised to enforce rules and manage the Services.

"Store": The portion of the Website through which Players may purchase digital perks (Vex+ and Amethyst Tokens).

"Ko-fi": The third-party payment platform (ko-fi.com) through which Store purchases are processed.

"Vex+": A recurring subscription tier available through the Store that provides cosmetic in-game perks.

"Amethyst Tokens": A one-time purchasable in-game item available through the Store.

"Content": Any text, images, video, audio, or other material posted, submitted, or otherwise provided through the Services.

You must be at least 13 years of age to use our Services. If you are between 13 and 17 years of age, you represent that you have obtained the permission of your parent or legal guardian to use the Services and to agree to these Terms on your behalf.

To play on VexSMP, you must own a legitimate, paid copy of Minecraft: Java Edition on an active Mojang/Microsoft account in good standing. Cracked or pirated copies of the game are not permitted and will be refused access automatically.

You are responsible for maintaining the security of your Minecraft account. Any activity that occurs through your account is your responsibility, whether or not you authorised it. If you believe your account has been compromised, please contact Microsoft/Mojang immediately and notify our staff.

You may not create multiple accounts to circumvent a ban, disciplinary action, or any other restriction we have applied to your primary account. Ban evasion using alternate accounts will result in all associated accounts being permanently banned.

All Players must adhere to the VexSMP server rules, which are published in full on the Rules page of our Website and may be updated from time to time. The rules are incorporated into these Terms by reference.

The following conduct is strictly prohibited and will result in immediate and permanent removal from the Services without warning or refund:

Using hacked clients, cheat software, modified clients that provide an unfair advantage, X-ray texture packs or resource packs, auto-clickers, macros, bots, or any third-party tool that automates or enhances gameplay beyond what is intended by Minecraft's base mechanics.

Engaging in harassment, hate speech, discrimination, or targeted bullying of any Player or staff member, whether in-game chat, Discord, or any other medium associated with VexSMP. This includes but is not limited to content targeting race, ethnicity, national origin, gender, sexual orientation, religion, disability, or age.

Sharing, posting, or distributing another person's private information ("doxxing") without their explicit consent.

Threatening, intimidating, or attempting to blackmail any Player, staff member, or VexSMP itself.

Attempting to compromise the security of the Server, Website, or any related infrastructure, including but not limited to DDoS attacks, SQL injection, brute-force attacks, or any other form of cyber attack.

Duplication of items through exploiting game bugs or glitches. Any discovered exploits must be reported to staff immediately. Intentional exploitation for personal gain will be treated as cheating.

Real-life trading ("IRL trading") — exchanging in-game items, currency, or advantages for real-world money, goods, or services outside of VexSMP's official Store.

Advertising other Minecraft servers, websites, services, or Discord servers without prior written permission from VexSMP staff.

Impersonating VexSMP staff or representing yourself as an official VexSMP representative when you are not.

The following conduct may result in a temporary or permanent ban at staff's discretion, depending on severity and context: griefing, theft, excessive toxicity, spamming, unsolicited solicitation of other players, and any other behaviour that staff reasonably determines to be harmful to the community or gameplay experience.

Staff decisions regarding disciplinary actions are final. VexSMP staff have sole discretion to issue warnings, temporary bans, permanent bans, rollbacks, item removals, and other sanctions as they deem appropriate. We reserve the right to take action against any Player for any conduct we determine to be contrary to the spirit of the server, even if such conduct is not explicitly listed in these Terms or our Rules.

VexSMP offers optional, cosmetic digital perks through the Store. Purchasing these perks is entirely voluntary. All purchases are processed by Ko-fi. By making a purchase, you also agree to Ko-fi's Terms of Service and Privacy Policy.

All of our Store items are cosmetic in nature. Vex+ provides cosmetic in-game effects and cosmetic bonuses. Amethyst Tokens are a one-time purchasable in-game cosmetic item. No Store purchase grants any advantage over other players in terms of gameplay mechanics, combat, resource gathering, or survival. VexSMP is, and will always remain, a server where skill and effort determine success.

All sales are final. We do not offer refunds except where required by applicable consumer protection law in your jurisdiction. If you are entitled to a statutory right of refund and wish to exercise it, please contact us within the statutory period via our Discord server before initiating a chargeback.

Chargebacks: If you initiate a chargeback or payment dispute with your bank or card provider without first contacting us and giving us an opportunity to resolve the issue, your account will be permanently banned from VexSMP. We take chargebacks very seriously as they represent fraudulent appropriation of digital goods. If you have a legitimate concern about a charge, please contact us first.

Vex+ is a recurring monthly subscription managed through Ko-fi. You may cancel your Vex+ subscription at any time through your Ko-fi account. Cancellation will take effect at the end of the current billing period. VexSMP staff cannot cancel your subscription on your behalf — you must manage this directly in Ko-fi.

VexSMP reserves the right to modify, suspend, or discontinue any Store item, perk, or feature at any time with reasonable notice. If we discontinue a perk you have purchased, we will make reasonable efforts to offer an equivalent replacement. We are not obligated to provide refunds for discontinued perks unless required by law.

Perks are tied to your Minecraft Java Edition username/UUID and are non-transferable to other accounts. If you change your Minecraft username, perks will follow your UUID automatically. VexSMP is not responsible for the loss of perks due to account compromise or account sharing.

If a Store purchase fails to be delivered within 48 hours of payment, please open a support ticket in our Discord server with your Ko-fi confirmation details and we will investigate and resolve the issue promptly.

You may interact with our Services in ways that generate content — for example, in-game builds, chat messages, Discord posts, and similar contributions ("User Content"). You retain ownership of any content you create.

By submitting User Content through our Services, you grant VexSMP a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute your User Content in connection with operating and promoting the Services (for example, using screenshots of in-game builds in promotional material). This licence ends when you delete the content or your access is terminated, except for content already reproduced or shared.

You represent and warrant that your User Content does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party, and does not violate any applicable law.

We reserve the right to remove any User Content at any time, for any reason, without notice, including content that we believe violates these Terms, our Rules, or that we otherwise find objectionable.

The VexSMP brand, name, logo, website design, and original written content are the intellectual property of VexSMP and are protected by copyright and trademark laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our original content without our express written permission.

Minecraft is a registered trademark of Mojang Studios, a subsidiary of Microsoft Corporation. VexSMP is an independent, community-run server and is not affiliated with, endorsed by, sponsored by, or otherwise connected to Mojang Studios or Microsoft Corporation in any way.

We operate in accordance with Mojang's Commercial Usage Guidelines for Minecraft servers. Our Store perks are designed to comply with Mojang's Marketplace Guidelines, which prohibit selling gameplay advantages.

If you believe that any content on our Website infringes your intellectual property rights, please contact us with details of the alleged infringement and we will investigate promptly.

If you are a copyright holder and believe that material on our Website or Server infringes your copyright, please submit a notice to us via our Discord server (open a ticket and request staff contact) with the following information:

A description of the copyrighted work you claim has been infringed. The specific location on our Website or Server where the allegedly infringing material is located. Your name, address, telephone number, and email address. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.

We will process valid DMCA notices and remove or disable access to the allegedly infringing material promptly.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VEXSMP DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any defects in the Services will be corrected.

We are not responsible for any loss of in-game progress, items, builds, or data resulting from server resets, rollbacks, crashes, hardware failures, acts of God, or any other cause beyond our reasonable control. While we make every effort to maintain stable and fair gameplay, we make no guarantees regarding uptime, data persistence, or continuity of the game world.

VexSMP is a community server operated by volunteers. We make no guarantee that staff will be available at any given time to handle reports, support requests, or disputes.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VEXSMP, ITS OPERATORS, STAFF, VOLUNTEERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO VEXSMP THROUGH THE STORE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) £10 GBP.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless VexSMP, its operators, staff, volunteers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of or inability to use the Services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit through the Services.

VexSMP reserves the right to suspend, restrict, or terminate your access to any or all of the Services at any time, for any reason, with or without notice, including but not limited to your violation of these Terms, conduct we determine to be harmful to the community, or actions that compromise the security or integrity of our Services.

Upon termination, all rights granted to you under these Terms immediately cease. Sections that by their nature should survive termination will do so, including but not limited to the sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

VexSMP is not obligated to issue refunds upon termination due to rule violations or misconduct. If your access is terminated through no fault of your own (for example, if we shut down the server permanently), we will make reasonable efforts to address outstanding Store purchases.

If you wish to voluntarily delete your data and terminate your relationship with VexSMP, please open a ticket in our Discord server. Note that moderation records (such as ban records) may be retained even after you request deletion, as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions. You agree that any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Slovenia.

We encourage you to contact us first if you have a dispute or concern. Most issues can be resolved informally and quickly through our Discord support system. Please open a ticket and a staff member will assist you.

Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your country of residence. If you are a consumer located in the European Union, you may be entitled to additional protections under EU consumer law, and you may have the right to bring a claim in your country of residence.

Entire agreement: These Terms, together with our Privacy Policy and Server Rules, constitute the entire agreement between you and VexSMP regarding the Services and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. VexSMP may assign these Terms without restriction.

Force majeure: We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, civil unrest, internet or infrastructure outages, or actions of third-party service providers.

Language: These Terms are written in English. If translated into other languages, the English version shall prevail in the event of any conflict.
